These terms govern your use of this website and, where indicated, the booking of travel arrangements with Kwai PM Kwai Travel and Tours Limited. Please read them before making an enquiry or a booking.
1. About these terms
This website is operated by Kwai PM Kwai Travel and Tours Limited, a company registered in the United Republic of Tanzania with offices at Sinza Kijiweni, Dar es Salaam. By using this website you accept these terms. If you do not accept them, please do not use the site.
2. Using this website
You may use this website to learn about our services and to contact us. You agree not to:
- use the site for any unlawful purpose, or in a way that could damage or impair it;
- submit false, misleading or fraudulent enquiries;
- attempt to gain unauthorised access to any part of the site, our management system, or any account;
- use automated systems to extract content or submit forms;
- copy or republish our content for commercial purposes without our written permission.
The staff login area is restricted to authorised employees of Kwai PM Kwai Travel and Tours Limited. Attempting to access it without authorisation is prohibited.
3. Enquiries are not bookings
Submitting the enquiry form does not create a booking and does not reserve anything. It begins a conversation. A booking exists only once we have issued a written confirmation and you have paid the required deposit.
4. Quotations and pricing
- Quotations are valid for the period stated on them, and otherwise for 14 days.
- Prices are quoted per person or per party as indicated, in United States Dollars or Tanzanian Shillings.
- Availability is not held until a deposit is received. Lodges and camps in peak season can sell out between quotation and confirmation.
- Quoted prices are based on costs, park fees, taxes and exchange rates applying at the date of quotation. Where a government or supplier increases park fees, concession fees or taxes after confirmation, we may pass on that increase, and we will tell you promptly if that happens.
5. Payment
- A deposit is required to confirm a booking. The amount is stated on your invoice.
- The balance is due by the date stated on your invoice, and before travel begins.
- We accept mobile money, bank transfer, and cash. Always quote your booking reference and keep your transaction reference.
- Bank charges and transfer fees are your responsibility unless we have agreed otherwise in writing.
6. Changes and cancellation
If you need to change or cancel a booking, tell us in writing as soon as possible. What we can recover depends on the terms of the lodges, camps, airlines and park authorities we have booked on your behalf. Some suppliers allow changes; others treat a deposit as non-refundable from the moment it is paid. We will always tell you what a change will cost before we make it.
Specific cancellation charges applying to your trip will be set out in your booking confirmation. Where those terms differ from this page, the terms in your booking confirmation apply.
If we have to cancel your trip for reasons within our control, we will offer you an alternative or a refund of monies paid to us for the cancelled arrangements.
7. Circumstances beyond our control
We are not liable for failure to perform where that failure results from events beyond our reasonable control, including severe weather, flooding, impassable roads, fire, epidemic or public health measures, civil unrest, strikes, airline schedule changes or cancellations, park closures, or acts of government. Where such an event affects your trip, we will do what we reasonably can to find alternatives.
8. Passports, visas and entry requirements
You are responsible for holding a valid passport, any required visa, and any vaccination certificate required for entry to Tanzania or any country on your itinerary. We can offer guidance, but requirements change and are ultimately a matter between you and the relevant authorities. We are not liable for costs arising from your being refused entry or boarding.
9. Travel insurance
We strongly recommend comprehensive travel insurance covering medical treatment, emergency evacuation, trip cancellation and curtailment, and baggage. Certain activities — including mountain trekking — may require specific cover, and you should check that your policy covers the altitude and activities on your itinerary.
10. Your responsibilities on a trip
- Follow the safety instructions of your guide, driver and lodge staff at all times.
- Observe park regulations and wildlife viewing rules.
- Tell us before travel about any medical condition, mobility limitation or dietary requirement affecting your participation.
- Treat local communities, staff and the environment with respect.
We may decline to carry, or may end the participation of, any traveller whose behaviour endangers themselves, other travellers, our staff or wildlife. No refund is due in those circumstances.
11. Third-party suppliers
Your trip involves services delivered by independent suppliers — lodges, camps, airlines, ferries, and park authorities. We select suppliers with care and manage your arrangements with them, but we are not responsible for their own acts or omissions beyond our reasonable control, and their own terms and conditions may apply to your stay or flight.
12. Intellectual property
The content of this website — text, layout, graphics and logos — belongs to Kwai PM Kwai Travel and Tours Limited or is used with permission, and is protected by copyright. You may view and print pages for your personal use in planning travel with us.
13. Accuracy of information
We take care to keep this website accurate, but details such as lodge facilities, road conditions, seasonal wildlife movements and park fees change. Nothing on this website forms part of a contract unless it is repeated in your written booking confirmation.
14. Limitation of liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded. Subject to that, our liability in connection with a booking is limited to the total amount you have paid to us for the arrangements concerned.
15. Complaints
If something goes wrong during your trip, tell your guide or contact our office immediately, so we have the opportunity to put it right while you are still with us. If a matter remains unresolved, write to us at booking@kwaipmkwaitravelandtours.com within 28 days of returning home.
16. Governing law
These terms are governed by the laws of the United Republic of Tanzania, and the courts of Tanzania have jurisdiction over any dispute arising from them.
